1. Purpose of these General Terms and Conditions
These General Terms and Conditions of Use (hereinafter "GTCU") define the terms and conditions of access to and use of the services offered by FlyPoola mobile application and web platform published by Mathieu Burthey Company LP and operated daily by the FlyPool team.
They govern the relationship between FlyPool and any user, whether passenger, driver, ambassador, partner or advertiser.
2. Definitions
- "FlyPool The car-sharing platform and associated services (web and mobile).
- "User Anyone registered with FlyPool.
- "Driver User proposing a trip.
- "Passenger User booking a trip.
- "FlyStore Integrated advertising space allowing the purchase or exchange of goods and services using FlyPoints and/or the advertiser's traditional currency.
- "FlyPoints Internal reward unit obtained through the use of FlyPool.
- "Ambassador User representing FlyPool in the field, responsible for promoting the service.
- "Advertiser/Partner Company purchasing advertising space or entering into a partnership with FlyPool.
3. Registration and account creation
3.1 Registration conditions
- Be at least 18 years old.
- Provide accurate information (last name, first name, email address, telephone number).
- Accept these Terms and Conditions and the Privacy Policy.
3.2 Identity verification
FlyPool reserves the right to request supporting documents (ID card, passport, driver's license).
3.3 Account security
The user is solely responsible for the confidentiality of his/her login and password. Any activity carried out via the user's account is deemed to have been carried out by the user.
4. Using FlyPool services
4.1 Car pooling
- Publication of journeys by drivers.
- Reservations by passengers via the app.
- Direct payment (excluding commission): FlyPool is not involved in the P2P financial transaction.
4.2 FlyStore
Three categories of products and services are offered:
- Redeemable only for FlyPoints.
- Payable in regular currency + FlyPoints (discount).
- Payable in traditional currency only.
4.3 FlyPoints system
- Allocation according to: routes, challenges, sponsorships, application activities.
- Conversion possible: discounts, services, donations, gifts, exclusive experiences.
- FlyPoints have no monetary value outside the FlyPool ecosystem.
5. User commitments
The user agrees to :
- Provide accurate information.
- Do not create fake accounts.
- Respect other users.
- Do not misuse FlyPool for fraudulent purposes (unauthorized advertising, spam, hacking).
6. Specific obligations
6.1 Conductors
- A valid driver's license.
- Ensuring passenger safety.
- Do not charge a higher price than the one displayed on the application.
6.2 Passengers
- Respect schedules and rules of courtesy.
- Do not use fake profiles.
6.3 Ambassadors
- Promote FlyPool in accordance with guidelines.
- Use official communication tools.
- Participate in local campaigns and activities.
6.4 Partners/Advertisers
- Provide accurate information on ads.
- Not to publish content that is illegal, discriminatory or contrary to FlyPool's values.
7. Transaction management
- P2P payments are made directly between users (driver ↔ passenger).
- FlyStore purchases are managed by FlyPool (secure payments, invoicing).
- FlyPoints are credited automatically after each eligible action.
8. FlyPool's responsibilities
- Ensure available and secure service.
- Verify the authenticity of profiles wherever possible.
- Not to be responsible for any incidents during the trip (accidents, delays, financial disputes).
9. Suspension and termination
FlyPool reserves the right to suspend or delete an account in the event of :
- Fraud.
- Non-compliance with the GCU.
- Suspicious or harmful activity in the community.
10. Personal data
The data collected is processed in accordance with the FlyPool Privacy Policy.
11. Advertising and partnerships
- Advertisers can buy space in the FlyStore.
- Users may be exposed to targeted advertising.
- FlyPool reserves the right to refuse campaigns that are contrary to its values.
12. Intellectual property
- The FlyPool brand, logo and mascot Tiko the Eco Turtle and its applications are protected.
- Unauthorized reproduction is prohibited.
13. Disputes
- The applicable law is that of the United Kingdom (registered office of Mathieu Burthey Company LP).
- In the event of a dispute, an amicable settlement will be preferred.
- Failing this, the matter will be referred to the competent courts.
Appendix 1 - Detailed FlyPoints system
1.1 Allocating FlyPoints
FlyPoints are awarded in several ways:
a) Journeys & carpooling
- 1 FlyPoint per kilometer driven (driver and passenger).
- Bonus of 20 FlyPoints for each journey made to or from an airport.
- 50 FlyPoints bonus for 10 trips completed in one month.
- Multiplier ×2 for peak hours.
b) Sponsorship and affiliation
- 3 FlyPoints for each referral who registers and completes his or her first trip.
- Reward levels :
- 10 referrals = +25 FlyPoints
- 25 referrals = +75 FlyPoints
- 50 referrals = +200 FlyPoints + exclusive badge
- 100 referrals = +500 FlyPoints + VIP benefits
c) Challenges
- Carpool Marathon 5 trips in 1 week = 100 FP.
- Night Owl 1 trip after 10pm = 25 FP.
- Eco-Friendly electric vehicle trip = 40 FP.
- Weekend Warrior 3 trips from Saturday to Sunday = 80 FP.
d) Engagement & interaction
- One trip = 15 FP.
- Review left on App Store/Play Store = 25 FP.
- Survey participation = 20 FP.
- Voluntary viewing of advertising = 10 to 30 FP.
1.2 Using FlyPoints
FlyPoints can be used in the following cases:
- Free or discounted curves FlyPool: partial or full payment for FlyPool trips.
- FlyStore products :
- 100% FlyPoints (e.g. goodies, travel accessories).
- Mix FlyPoints + credit card (e.g. headphones, powerbank).
- 100% monetary payment (e.g. third-party premium services).
- Gift cards (Amazon, Google Play, Apple).
- Partner services airport restaurants, coworking spaces, hotels.
- Exclusive experiences sponsored trips, VIP packages.
- Donations to partner NGOs 1 = 150 FlyPoints.
1.3 Validity and expiration
- FlyPoints are valid 24 months after award.
- After this period, they expire automatically.
Appendix 2 - Specific FlyStore rules
2.1 Products & services
- Products redeemable in FlyPoints only e.g. mugs, stickers, international SIM cards.
- Hybrid products (FlyPoints + currency): e.g. technological gadgets, premium accessories.
- Products can only be purchased in conventional currency e.g. travel insurance, airline tickets.
2.2 How to buy
- Secure payment (Visa, Mastercard, PayPal, Mobile Money).
- Possibility of combining FlyPoints + card payment.
- Invoice generated automatically after each purchase.
2.3 Delivery & returns
- Delivery within 7 to 15 working days (depending on country).
- Returns possible within 14 days (excluding digital or personalized products).
- Return shipping costs are at the user's expense, unless the product is defective.
2.4 Advertising and advertisers
- Advertisers can reserve advertising space in the FlyStore.
- Pricing according to placement (home page, banner, sponsored product).
- FlyPool reserves the right to refuse advertising that is contrary to its values (alcohol, tobacco, discriminatory content).
Appendix 3 - Charter for ambassadors and advertising partners
3.1 FlyPool ambassadors
Role :
- Promote FlyPool locally and digitally.
- Participate in community growth.
- Show FlyPool values.
Commitments :
- Regular communication with the central team.
- Respect the rules of transparency (don't promise false rewards).
- No representation of FlyPool on non-validated channels (TV, media) without written agreement.
Awards :
- Bonus in FlyPoints.
- Commissions on partnerships signed locally.
- Progressive status (Ambassador → Regional Leader → Coordinator).
3.2 Advertising partners
Conditions:
- Be a legally registered company.
- Products comply with local legislation.
- Campaign payments validated before distribution.
Commitments :
- On-time delivery of advertising content.
- Compliance with FlyPool graphic charters and guidelines.
Advantages :
- Visibility among a targeted community of travelers, expats and connected urbanites.
- Analytical data (impressions, clicks, conversions).
- Possibility of co-branding for events or digital campaigns.
14. Changes to Terms and Conditions
FlyPool reserves the right to modify these TOU at any time. Users will be notified of any major changes.
